Preparing for Divorce

Your divorce proceedings will vary depending on a number of factors, but there are a few things anyone can do to prepare:

  • Gather documentation - Divorce is a legal process that requires a lot of paperwork. Gather financial statements, bank records, and other applicable paperwork to expedite the process.
  • Separate your finances - As soon as you decide to file for divorce, try to organize your finances and separate yourself financially from your spouse.
  • Determine a visitation schedule - If you have children, attempt to work out a temporary custody and visitation schedule with your spouse. Consider working with an attorney early in the process for advice and guidance in these issues.

Preparing for child custody proceedings

If your divorce will require child custody determinations, you may want to start recording case-relevant information now. Start a journal and keep records of any missed pick-up times, missed visitations, or other parenting errors. This helps organize facts and makes you a more convincing witness.

When Should I File for Divorce?

There is no definitive answer to this question. The answer is different for each couple. However, it is important to be emotionally prepared for divorce and work with an attorney who is compassionate and understanding in this difficult time.

I am attorney Daniel Bacalis, and I encourage you to contact a lawyer to talk about your upcoming divorce. In a free consultation, I can answer your divorce-related questions and help you determine if now is the time to begin the divorce process.
