In addition to adoption, married couples in Texas can also become parents through surrogacy. A type of assisted reproduction, surrogacy involves a woman who agrees to become pregnant for the purpose of gestating and giving birth to a child for others to raise. Protecting Legal RightsA surrogate parent agreement or gestational agreement is essential to protect the legal rights of all parties involved, including the surrogate mother and her husband, if she is married, as well as the intended parents and the child. Under Texas surrogacy law, the intended parents, not the gestational mother, are the legal parents of a child born to a surrogate mother if all parties entered into a valid gestational agreement at least two weeks before the embryo is transferred to the surrogate mother. Texas surrogacy law allows the intended parents to use their own genetic material or the sperm or egg may come from a donor.
